Judicial Council Prosecutors Chamber to Consider Justice Minister’s Proposal to Impose Disciplinary Penalty on Sarafov

The Prosecutors Chamber of the Supreme Judicial Council (SJC) is scheduled to convene on Wednesday to review a formal proposal concerning disciplinary action. The initiative, submitted by caretaker Justice Minister Andrey Yankulov, aims to impose a disciplinary penalty on Borislav Sarafov, who previously served as acting Prosecutor General. The proposal, which was initially put forward at the end of March, is predicated on five specific instances detailing alleged professional misconduct.

Minister Yankulov contends that the actions and inactions of the acting Prosecutor General constituted serious disciplinary violations, warranting the most severe penalty: dismissal from office. Evgeni Ivanov, chair of the disciplinary committee within the SJC Prosecutors Chamber, confirmed that the proposal is admissible. He stated that because it was submitted by a minister, it must be considered, irrespective of Sarafov’s current employment status.

The procedural context surrounding this review is notable. Sarafov formally resigned as acting Prosecutor General on April 22, as documented on the prosecution service’s website. Later that same day, the SJC Prosecutors Chamber appointed deputy prosecutor general Vanya Stefanova as the acting prosecutor general.

The meeting of the chamber will therefore address the formal disciplinary proceedings initiated against Sarafov. The review of Yankulov’s disciplinary recommendation represents a significant procedural step following Sarafov’s departure. The decision reached by the chamber regarding the proposal is subject to an appeal period of 14 days.
